Terms of Service

1. Acceptance of Terms

By accessing or using Mezcalsearch (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. These terms constitute a legally binding agreement between you and Mezcalsearch.

2. Eligibility

You must be at least 21 years of age to use this Service, or of legal drinking age in your jurisdiction, whichever is higher. By using the Service, you represent that you meet this requirement. We do not knowingly collect information from users who do not meet the age requirement.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information when creating an account.
  • You are solely responsible for all activity that occurs under your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use the Service to:

5. Content & Intellectual Property

  • Your content: You retain ownership of any reviews, ratings, photos, or other content you submit. By submitting content, you grant Mezcalsearch a non-exclusive, royalty-free license to use, display, and distribute it in connection with the Service.
  • Our content: All logos, trademarks, design elements, and platform content are owned by Mezcalsearch and protected by copyright and trademark laws.
  • Third-party content: Product images and brand information are provided by producers and distributors. We do not claim ownership of third-party trademarks.

6. Subscriptions & Payments

  • Premium features may require a paid subscription.
  • Payments are processed through Stripe. We do not store your full credit card information.
  • Subscriptions auto-renew unless cancelled before the renewal date.
  • Refunds are provided at our sole discretion and in accordance with applicable law.
  • We reserve the right to change pricing with advance notice.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. Ratings and reviews reflect user opinions, not our endorsement.

8. Limitation of Liability

To the maximum extent permitted by law, Mezcalsearch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Mezcalsearch, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these terms.

10. Governing Law & Dispute Resolution

These terms shall be governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be resolved through binding arbitration in New York County, New York.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these terms. Upon termination, your right to use the Service ceases immediately. Provisions related to intellectual property, indemnification, and limitation of liability shall survive termination.

12. Changes to Terms

We may modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised terms.

13. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
